Preliminary Affirmative Determination On Pvlt From Vietnam

As of 30 December 2020, the U.S. Department of Commerce (DOC) released the Preliminary Affirmative Determination of Sales at Less Than Fair Value for Passenger Vehicle and Light Truck Tires (PVLT) from Korea, Taiwan, Thailand, and Vietnam.

According to this Preliminary Determination of DOC, the two mandatory respondents including Kenda Rubber (Vietnam) Co., Ltd. that is represented by IDVN Lawyers in coordination with Steptoe & Johnson LLP, and Sailun (Vietnam) Co., Ltd. are determined not to sell less than fair value and enjoy the preliminary dumping duty rate of 0.00%. On that basis, the other voluntary enterprises that cooperated in this investigation also benefit from the same duty rate at 0.00% (the estimated weighted-average dumping margins of the two mandatory respondents above). The enterprises not mentioned in the list will be imposed a countrywide rate of 22.30%.

In the next step, DOC intends to verify the information provided by the mandatory respondents through requesting additional document and information in lieu of an on-site verification due to the global COVID-19 pandemic.

The Final Determination is expected to be issued by May 14, 2021, after DOC finishes the verification procedures. Under the Preliminary Determination, in case the mandatory respondents included Kenda Rubber (Vietnam) Co., Ltd. and Sailun (Vietnam) Co., Ltd. continue to be determined not to sell less than fair value or dumping margin less than 2% in the Final Determination, these enterprises will be exempted from the anti-dumping duty order under this investigation.
