[LEGAL UPDATE | TEAM TRADE]
On June 24, 2026, the U.S. Department of Commerce (DOC) and the U.S. International Trade Commission (ITC) issued the final results of the fourth sunset review, determining that revocation of the antidumping duty (AD) order on certain frozen fish fillets from Vietnam would likely lead to the continuation or recurrence of dumping and material injury to the domestic industry in the United States.
*Detailed contents are as follows:
1. Scope of investigation: The products covered are frozen fish fillets, including regular fillets (boneless fillets with the belly flap intact), shank fillets (boneless fillets with the belly flap removed), and boneless shank fillets cut into strips (fillet strips/finger), including fillets cut into strips, chunks, blocks, skewers, or any other shape, whether or not breaded or marinated. These include the species Pangasius bocourti, Pangasius hypophthalmus, and Pangasius micronemus, commonly referred to as frozen “basa” and “tra” fillets.
* Excluded from the scope are: Frozen whole fish (whether or not dressed – deheaded, skinned, and eviscerated), frozen steaks (bone-in, cross-section cuts of dressed fish), and frozen belly-flap nuggets (the belly flaps).
2. HS classification: Products are primarily classifiable under subheading 0304.62.0020, and may enter under subheadings 0305.59.0000, 1604.19.2100, 1604.19.3100, 1604.19.4100, 1604.19.5100, 1604.19.6100, and 1604.19.8100.
3. Measures applied:
– Continuation of the antidumping duty order.
– U.S. Customs and Border Protection (CBP) will continue to collect AD cash deposits at the rates in effect at the time of entry.
4. Effective date: The effective date of the continuation of the order is June 24, 2026.
