On October 1, 2023, the Supreme People’s Court issued Decision No. 364/QD-CA in 2023 announcing 07 additional Case Laws that have been approved by the Council of Judges of the Supreme People’s Court and shall be applied by courts in trial from November 1, 2023. 07 new Case Laws issued under Decision 364/QD-CA includes:
- Case Law No. 64/2023/AL on the determination of bracket and determination of aggravating bracket of “organized crime” in the offence of “Kidnapping for ransom”
- Case Law No. 65/2023/AL on prosecution of criminal liability for “Human Trafficking”
- Case Law No. 66/2023/AL on the determination of “Human Trafficking”
- Case Law No. 67/2023/AL on the persons who may receive objects in case of division of common property
- Case Law No. 68/2023/AL on the entitlement of overseas Vietnamese heirs to inherit an asset in kind of a house
- Case Law No. 69/2023/AL on the jurisdiction of commercial arbitration in Non-Disclosure and Non-Compete Agreement dispute resolution
- Case Law No. 70/2023/AL on termination of labour contract for employees who are part-time trade union cadres
